GTC

1. Subject Matter of the GTC
These General Terms and Conditions govern the contractual relationship between AcuMax Med AG (hereinafter referred to as "AcuMax") and the customer (retailer, company, end user). Deviating terms and conditions of customers shall only apply with the written consent of AcuMax.

2. Offer and Order
The offer on www.acumax.ch is non-binding. By placing an order by telephone, fax, e-mail or via the Internet (online shop), the customer submits a binding offer to conclude a contract. The contract is concluded upon acceptance of this offer by AcuMax by telephone, fax, letter post, e-mail or by delivery of the order. The price in the order confirmation or at the time of delivery is decisive. AcuMax addresses its products to customers domiciled/residing in Switzerland. Foreign customers who wish to enter into a business relationship with AcuMax are requested to contact AcuMax. The products presented on www.acumax.ch are subject to deviations in terms of illustration, design, packaging or technical characteristics. 

3. Credit Limit
The credit limit for each merchant is set by AcuMax. The credit limit is constantly reviewed and adjusted to the business volume where possible.

4. Minimum Order Value
To cover costs, AcuMax reserves the right to introduce a minimum order value at any time. For orders below a net order value of CHF 90, a minimum quantity surcharge of CHF 6.90 will be charged.

5. Shipping and Delivery Conditions
Shipping is at the customer's risk and usually ex warehouse. Packaging and shipping costs will be charged to the customer. All delivery dates specified by AcuMax are non-binding unless confirmed in writing. However, items available from stock are usually delivered within 24 hours. If the delivery date agreed in writing cannot be met, AcuMax has the option to deliver within the following 30 days. The customer has no right of cancellation. Unless otherwise stated on the order, AcuMax reserves the right to carry out either complete or partial deliveries. Claims for damages on the part of the customer arising from late delivery are excluded to the extent permitted by law.

Shipping by parcel service provider
Orders from an order value of CHF 300.-- are delivered free of shipping costs within Switzerland and Liechtenstein. For orders below an order value of CHF 300.--, shipping costs are calculated as follows:
With DPD or Planzer (tabular shipping costs) the shipping costs per parcel are CHF 10.90.
With Swiss Post, the shipping costs A-Post per parcel are CHF 11.90.
With Swiss Post, the shipping costs A-Post per parcel are CHF 12.90.

Shipping by forwarding agent
Large deliveries (pallets) as well as treatment tables, medical devices and similar are delivered by forwarding agent or with the AcuMax delivery service and are charged individually according to cost and delivery address.

6. Prices and Terms of Payment
Our prices are in Swiss francs (CHF). All prices are exclusive of VAT. The customer may choose between advance payment or, in special cases, payment by invoice.

AcuMax reserves the right to change prices after conclusion of the contract if the cost factors relevant to pricing have demonstrably changed.

7. Retention of Title
The delivered goods remain the property of AcuMax until full payment of all claims. AcuMax is authorised to have a corresponding register entry made.

8. Warranty and Liability
The customer's warranty claims are limited to the scope of the manufacturer's warranty towards AcuMax. AcuMax assumes no guarantee or liability for the intended purpose of certain products or their functionality within the customer's application. To the extent permitted by law, AcuMax accepts no liability whatsoever for direct or indirect damages or financial loss in the event of defects or improper handling of the product.

9. Returns
Exchange is only possible in the event of incorrect delivery or manufacturing faults. The goods must be checked immediately upon receipt. Any defects must be reported in writing within 5 working days. Before any return, a return authorisation number (RMA number) must be obtained from AcuMax. The issuance of an RMA number does not in any case constitute recognition of a defect or other complaints by the customer. The following are generally excluded from returns:

Products not purchased from AcuMax
Products without original packaging
Damaged products
Incomplete products
Promotions and discount items (remaining stock)

Return shipment is at the expense and risk of the customer. The return must be made within 5 working days after receipt of the goods. Goods returned later may be rejected by AcuMax.

10. Safety Precautions and Product Information
By ordering and purchasing products, the customer undertakes to store and use the products properly. The customer is obliged to take all necessary precautions for themselves, patients and furniture. Special safety precautions apply, among other things, to the use of moxa. The customer must inform themselves accordingly.

If, in the case of product information for a medical device, less than the three official languages of Switzerland are used, or if these are only available in German or English, acceptance of the GTC by the customer confirms that they are a healthcare professional and have the necessary technical and linguistic skills and are in agreement with this. Furthermore, the customer confirms that the protection of patients, users and third parties is guaranteed and that effective and performance-related use is not jeopardised.

11. Data Protection
When collecting, processing and using personal or company-related data, AcuMax complies with the provisions of Swiss data protection law. Personal data is only collected and used for the execution of contractual relationships. This data is only passed on to third parties to the extent that this is absolutely necessary for proper execution of the contract. In addition, personal data is appropriately protected against access by unauthorised third parties.

12. Jurisdiction and Applicable Law
All obligations arising from the contractual relationship are subject to Swiss law. For all disputes arising from the contractual relationship as well as about its origin and validity, the place of jurisdiction for company customers and private individuals is Bad Zurzach.

13. Privacy Policy for the Use of Google Analytics
This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses so-called "cookies", text files which are stored on your computer and which enable your use of the website to be analysed. The information generated by the cookie about your use of this website is generally transferred to a Google server in the USA and stored there. If IP anonymisation is activated on this website, however, your IP address will first be shortened by Google within member states of the European Union or other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. Google will use this information to evaluate your use of the website, to compile reports on website activities for the website operator and to provide other services relating to the use of the website and the Internet. Google may also transfer this information to third parties where required to do so by law or where such third parties process this data on Google's behalf. The IP address transmitted by your browser as part of Google Analytics will not be merged with other data from Google. You may refuse the use of cookies by selecting the appropriate settings on your browser; however, please note that in this case you may not be able to use the full functionality of this website.
