GTC
1. Subject Matter of the GTC
These General Terms and Conditions govern the contractual relationship between AcuMax Med AG (hereinafter referred to as "AcuMax") and the customer (trade, company, end user). Deviating terms and conditions of customers only apply with the written consent of AcuMax.
2. Offer and Order
The offer on www.acumax.ch is non-binding. By placing an order by telephone, fax, e-mail or via the internet (online shop), the customer submits a binding offer to conclude a contract. The contract is concluded upon acceptance of this offer by AcuMax by telephone, fax, post, e-mail or by delivery of the order. The decisive price is that in the order confirmation or at the time of delivery. AcuMax offers its products to customers domiciled/resident in Switzerland. Foreign customers wishing to establish a business relationship with AcuMax are requested to contact AcuMax. Deviations of the products presented on www.acumax.ch with regard to illustration, design, packaging or technical properties are reserved.
3. Credit Limit
The credit limit of each merchant is set by AcuMax. The credit limit is continuously reviewed and, where possible, adjusted to the business volume.
4. Minimum Order Value
For reasons of cost coverage, AcuMax reserves the right to introduce a minimum order value at any time. For orders below a net order value of CHF 90.-- a low-quantity surcharge of CHF 6.90 will be charged.
5. Shipping and Delivery Terms
Shipping is at the customer's risk and usually ex stock. Packaging and shipping costs are charged to the customer. All delivery dates stated by AcuMax are non-binding, unless confirmed in writing. However, items available ex stock are generally delivered within 24 hours. If the delivery date agreed in writing cannot be met, AcuMax has the option of nevertheless delivering within the following 30 days. The customer has no right of withdrawal. Unless the order states otherwise, AcuMax reserves the right to make full or partial deliveries at its discretion. Claims for damages by the customer resulting from delayed delivery are, to the extent permitted by law, excluded.
Shipping by parcel service provider
Orders of CHF 300.-- or more are delivered free of charge within Switzerland and Liechtenstein. For orders of less than CHF 300.--, shipping costs will be calculated as follows:
By DPD or Planzer (tabular shipping costs) the shipping costs per parcel are CHF 10.90.
By Swiss Post, shipping costs for A-Post per parcel are CHF 11.90.
By Swiss Post, shipping costs for A-Post per parcel are CHF 12.90.
Shipping by freight forwarder
Large deliveries (pallets) as well as treatment couches, medical equipment and similar items are delivered by forwarding agent or with the AcuMax delivery service and are charged individually according to effort and delivery address.
6. Prices and Terms of Payment
Our prices are in Swiss francs (CHF). All prices are exclusive of value-added tax. The customer may choose to pay by advance payment or, in special cases, by invoice.
AcuMax reserves the right to change prices after conclusion of the contract if the cost factors relevant to price formation have demonstrably changed.
In the case of special agreements deviating from the usual terms of payment, in particular for instalment payments or individual payment agreements, we reserve the right to charge a fee of up to CHF 50.– for the additional administrative work incurred.
7. Retention of Title
The delivered goods remain the property of AcuMax until all claims have been paid in full. AcuMax is authorised to have a corresponding entry made in the register.
8. Warranty and Liability
The customer's warranty claims are limited to the scope of the warranty of the respective manufacturer towards AcuMax. AcuMax does not assume any warranty or liability for the intended purpose of certain products or their functionality within the customer's application. Any liability on the part of AcuMax for direct or indirect damages as well as for loss of assets due to defects or improper handling of the product is excluded to the extent permitted by law.
9. Returns
Exchange is only possible in the event of incorrect delivery or manufacturing defects. The goods must be checked immediately upon receipt. Any defects must be reported in writing within 5 working days. Before any return is made, a return authorisation number (RMA number) must be obtained from AcuMax. The issue of an RMA number does not in any case constitute recognition of a defect or other complaints by the customer. The following items are generally excluded from return:
- Products not purchased from AcuMax
- Products without original packaging
- Damaged products
- Incomplete products
- Promotions and discount items (remaining stock)
10. Safety Precautions and Product Information
By ordering and purchasing products the customer undertakes to ensure proper storage and use of the products. The customer is obliged to take all necessary precautions for him/herself, for patients and for furniture. Special safety precautions apply, inter alia, when using Moxa. The customer is required to inform him/herself about this in detail.
11. Data Protection
When collecting, processing and using personal or company-related data, AcuMax observes the provisions of Swiss data protection law. Personal data is collected and used solely for processing contractual relationships. This data is only passed on to third parties to the extent absolutely necessary for the proper processing of the contract. In addition, personal data is appropriately protected against access by unauthorised third parties.
12. Place of Jurisdiction and Applicable Law
All obligations arising from the contractual relationship are subject to Swiss law. For all disputes arising from the contractual relationship as well as its creation and effectiveness, the place of jurisdiction for corporate and private customers is Bad Zurzach.
13. Privacy Policy for the Use of Google Analytics
This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses so-called "cookies", text files which are stored on your computer and enable an analysis of the use of the website by you. The information generated by the cookie about your use of this website is usually transferred to a server of Google in the USA and stored there. If IP anonymisation is activated on this website, your IP address will, however, be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a server of Google in the USA and shortened there. Google will use this information to evaluate your use of the website, compile reports on website activity for the website operator, and provide other services relating to website activity and internet usage. Google may also transfer this information to third parties if required to do so by law or if third parties process this data on Google's behalf. The IP address transmitted by your browser within the scope of Google Analytics will not be merged with other data from Google.
